1 Definitions
- Shop – online shop run by Nox2 sp. z o.o., available at www.cool5.eu.
- Customer – an individual, legal entity or organisational unit that purchases products from the Store.
- Seller – Nox2 sp. z o.o., with registered office at ul. Sarmacka 5G, 02-972 Warsaw, NIP: 9512604898.
- Merchandise – gas aerosols for car air conditioning and vehicle care chemicals available in theShop.
- Working days – days from Monday to Friday, excluding public holidays.
2 Scope of services provided
- The shop sells retail and wholesale products for car care and air-conditioning maintenance.
- Sales are conducted via the online shop www.cool5.eu and possibly other sales channels (e.g. by telephone or e-mail).
- All products offered in the Shop are brand new, free of defects and comply with the applicable standards.
3 Rules for placing orders
- The customer can place an order via the website, by telephone or by e-mail.
- Orders are processed after full payment has been made or, in the case of cash on delivery, after the order has been approved.
- The customer undertakes to provide the correct data necessary to process the order.
- The seller reserves the right to cancel an order in the event that false data is suspected.
4 Prices and payment methods
- All prices quoted in the Shop are gross prices (including VAT).
- The customer can make the payment:
- by bank transfer,
- via electronic payment systems (Przelewy24, PayPal).
- Delivery costs are added to the price of the products in accordance with the delivery price list available on the Shop website.
5 Fulfilment and delivery of orders
- Orders are processed within 1 to 5 working days after payment is credited.
- Delivery is made via courier companies or InPost parcel machines.
- The customer is obliged to check the condition of the parcel upon receipt. If the parcel is damaged, he/she should draw up a damage protocol in the presence of the courier.
6 Complaints and returns
- The customer has the right to return the goods within 30 days of receipt, in accordance with the returns policy described on theStore website.
- Returns are only possible on unopened products and in their original packaging.
- In the case of a defective product, the customer can make a complaint by e-mail to office@nox2.eu or in writing to the company’s address.
- The Seller will consider the complaint within 14 days of receipt and will inform the Customer of further proceedings.
7 Liability and limitations
- The seller is not liable for damage resulting from improper use of the purchased products.
- Products containing aerosols and chemicals should be stored and used in accordance with the instructions on the packaging.
- The vendor is not responsible for delays in delivery due to independent reasons.
8 Withdrawal from the agreement
- The customer has the right to withdraw from the contract within 30 days of receipt of the goods without giving any reason.
- In order to exercise the right of withdrawal, the Customer should send a statement to this effect to the e-mail address office@nox2.eu or to the company’s registered address.
- Refunds will be made within 14 days of receipt of the returned goods.
9 Final provisions
- In matters not covered by these terms and conditions, the provisions of the Civil Code and the Consumer Rights Act shall apply.
- The seller reserves the right to amend the terms and conditions.
- Disputes arising from the performance of the sales contract shall be settled by the court having jurisdiction over the Seller’s registered office.
