1 Definitions

  • Shop – online shop run by Nox2 sp. z o.o., available at www.cool5.eu.
  • Customer – an individual, legal entity or organisational unit that purchases products from the Store.
  • Seller – Nox2 sp. z o.o., with registered office at ul. Sarmacka 5G, 02-972 Warsaw, NIP: 9512604898.
  • Merchandise – gas aerosols for car air conditioning and vehicle care chemicals available in theShop.
  • Working days – days from Monday to Friday, excluding public holidays.

2 Scope of services provided

  1. The shop sells retail and wholesale products for car care and air-conditioning maintenance.
  2. Sales are conducted via the online shop www.cool5.eu and possibly other sales channels (e.g. by telephone or e-mail).
  3. All products offered in the Shop are brand new, free of defects and comply with the applicable standards.

3 Rules for placing orders

  1. The customer can place an order via the website, by telephone or by e-mail.
  2. Orders are processed after full payment has been made or, in the case of cash on delivery, after the order has been approved.
  3. The customer undertakes to provide the correct data necessary to process the order.
  4. The seller reserves the right to cancel an order in the event that false data is suspected.

4 Prices and payment methods

  1. All prices quoted in the Shop are gross prices (including VAT).
  2. The customer can make the payment:
  • by bank transfer,
  • via electronic payment systems (Przelewy24, PayPal).
  1. Delivery costs are added to the price of the products in accordance with the delivery price list available on the Shop website.

5 Fulfilment and delivery of orders

  1. Orders are processed within 1 to 5 working days after payment is credited.
  2. Delivery is made via courier companies or InPost parcel machines.
  3. The customer is obliged to check the condition of the parcel upon receipt. If the parcel is damaged, he/she should draw up a damage protocol in the presence of the courier.

6 Complaints and returns

  1. The customer has the right to return the goods within 30 days of receipt, in accordance with the returns policy described on theStore website.
  2. Returns are only possible on unopened products and in their original packaging.
  3. In the case of a defective product, the customer can make a complaint by e-mail to office@nox2.eu or in writing to the company’s address.
  4. The Seller will consider the complaint within 14 days of receipt and will inform the Customer of further proceedings.

7 Liability and limitations

  1. The seller is not liable for damage resulting from improper use of the purchased products.
  2. Products containing aerosols and chemicals should be stored and used in accordance with the instructions on the packaging.
  3. The vendor is not responsible for delays in delivery due to independent reasons.

8 Withdrawal from the agreement

  1. The customer has the right to withdraw from the contract within 30 days of receipt of the goods without giving any reason.
  2. In order to exercise the right of withdrawal, the Customer should send a statement to this effect to the e-mail address office@nox2.eu or to the company’s registered address.
  3. Refunds will be made within 14 days of receipt of the returned goods.

9 Final provisions

  1. In matters not covered by these terms and conditions, the provisions of the Civil Code and the Consumer Rights Act shall apply.
  2. The seller reserves the right to amend the terms and conditions.
  3. Disputes arising from the performance of the sales contract shall be settled by the court having jurisdiction over the Seller’s registered office.
